California Smoking Laws
California may have the most comprehensive state laws restricting in the United States. Here is a short list of California smoking laws:
The Workplace
It is illegal to smoke in any workplace in California with some exceptions. These include the cabs of trucks or tractors when another employee is not present, Theatrical productions sites where smoking is part of the story line, certain places in hotels, retail tobacco shops, employee break rooms with certain conditions met, small businesses as well as other exceptions.
Multi-unit Residences
Because indoor common areas such as hallways, stairways and laundry areas of apartment buildings and condos are considered “workplaces” in the California law, smoking is not permitted in these areas.
Government Buildings
All parts of state, county and local office buildings, and 20 feet surrounding those buildings are non-smoking. This law also covers state-owned passenger vehicles such as buses or police cars.
Playgrounds, Schools and Daycares
Smoking is prohibited within 25 feet of a play ground or “tot lot,” which is fineable up to $250 for each offense and within school buildings and daycare centers with a hefty fine of $1000 for each offense.
Planes, Trains and Automobiles
Although smoking on planes has been in effect for some time, California has taken things a step further and banned smoking on trains, public transportation and even in vehicles. As a piece of landmark legislation, California was one of the first to pass a law making it illegal to smoke in a car with someone under the age of 18.
Local Law Takes Precedence
The State legislature has allowed localities to pass their own smoking bans that place tighter restrictions on where people smoke. This may include beaches and other outside areas. One locality recently entertained banning smoking on private outdoor areas such as the porches of houses and condominiums.
